1. Objeto

Estos términos regulan el acceso y uso de la API de Profiting ("la API"), operada por Profiting (profiting.pro), por parte de la empresa suscriptora ("el Cliente"). Al contratar un plan, crear una cuenta o usar una API key, el Cliente acepta estos términos.

2. La información no es consejo financiero

Los datos servidos por la API (Profits, SuperProfits, UltraProfits, señales LONG/SHORT, cotizaciones, rendimiento y noticias) tienen carácter exclusivamente informativo y no constituyen asesoramiento financiero, recomendación de inversión ni oferta de compra o venta de ningún instrumento. El rendimiento pasado no garantiza resultados futuros. Toda decisión de inversión tomada por el Cliente o por sus usuarios finales es responsabilidad exclusiva de quien la toma. El Cliente se obliga a trasladar este aviso de forma visible a sus usuarios finales cuando muestre datos de la API.

3. Uso permitido

El Cliente puede consumir la API para integrar los datos en sus propios productos y servicios. No está permitido: (a) revender, sublicenciar o redistribuir los datos en bruto como producto sustitutivo de la API; (b) usar los datos para entrenar modelos o construir servicios que compitan directamente con Profiting; (c) eludir los límites de uso, la autenticación o las restricciones técnicas; (d) compartir las API keys con terceros ajenos a la organización del Cliente.

4. API keys y seguridad

Las API keys son personales de la cuenta del Cliente, que es responsable de su custodia y de toda la actividad realizada con ellas. Las keys no deben exponerse en código cliente (navegador o apps móviles). Ante una sospecha de filtración, el Cliente debe revocar la key desde la consola de inmediato. Profiting podrá suspender keys ante indicios de abuso o compromiso.

5. Límites de uso y cuotas

Cada plan incluye un límite de peticiones por minuto y una cuota mensual, publicados en la consola y la documentación. Superados los límites, la API responderá con el código 429 hasta que la ventana o el ciclo mensual se renueven. Profiting puede ajustar los límites técnicos de forma razonable notificándolo con antelación.

6. Nivel de servicio (SLA)

Profiting persigue una disponibilidad mensual de la API del 99,5 %, excluyendo mantenimientos programados (anunciados con al menos 24 horas) y causas de fuerza mayor. La API se presta "tal cual"; los datos dependen de fuentes de mercado de terceros y pueden sufrir retrasos, huecos o correcciones. Los planes A medida pueden pactar por escrito un SLA específico con compensaciones.

7. Pagos, renovación y cancelación

Las suscripciones se facturan por adelantado con renovación mensual automática. El Cliente puede cancelar en cualquier momento; el acceso continúa hasta el fin del período pagado y no se prorratean devoluciones salvo obligación legal. El impago suspende el acceso a la API. Los períodos de prueba gratuita expiran automáticamente si no se convierten en suscripción.

8. Propiedad

Los datos, la marca y la tecnología de la API son propiedad de Profiting o de sus licenciantes. El Cliente conserva la propiedad de sus productos y de los datos que genere con ellos. El Cliente puede citar a Profiting como fuente de los datos, sin sugerir aprobación o asociación más allá de la relación contractual.

9. Limitación de responsabilidad

En la máxima medida permitida por la ley, Profiting no responderá de pérdidas de beneficios, de datos o daños indirectos derivados del uso de la API, incluidas decisiones de inversión basadas en los datos. La responsabilidad total agregada de Profiting queda limitada al importe pagado por el Cliente en los 12 meses anteriores al hecho que la origine.

10. Suspensión y terminación

Profiting puede suspender o terminar el acceso ante incumplimiento de estos términos, uso fraudulento o riesgo para la plataforma, notificándolo al Cliente. El Cliente puede terminar cancelando su suscripción. Las cláusulas 2, 8 y 9 sobreviven a la terminación.

11. Cambios y contacto

Profiting puede actualizar estos términos publicando la nueva versión en esta página y notificando los cambios materiales por email con al menos 15 días de antelación. El uso continuado de la API tras la fecha efectiva supone aceptación. Contacto: no-reply@profiting.pro.

These terms govern access to and use of the Profiting API ("the API"), operated by Profiting (profiting.pro), by the subscribing company ("the Customer"). By purchasing a plan, creating an account or using an API key, the Customer accepts these terms.

2. Not financial advice

The data served by the API (Profits, SuperProfits, UltraProfits, LONG/SHORT signals, quotes, performance and news) is provided for informational purposes only and does not constitute financial advice, an investment recommendation or an offer to buy or sell any instrument. Past performance does not guarantee future results. Any investment decision made by the Customer or its end users is the sole responsibility of the person making it. The Customer must display this notice prominently to its end users wherever API data is shown.

3. Permitted use

The Customer may consume the API to integrate the data into its own products and services. The following is not allowed: (a) reselling, sublicensing or redistributing the raw data as a substitute for the API; (b) using the data to train models or build services that directly compete with Profiting; (c) circumventing usage limits, authentication or technical restrictions; (d) sharing API keys with third parties outside the Customer's organization.

4. API keys & security

API keys belong to the Customer's account, which is responsible for safeguarding them and for all activity performed with them. Keys must not be exposed in client-side code (browsers or mobile apps). If a leak is suspected, the Customer must revoke the key from the console immediately. Profiting may suspend keys upon signs of abuse or compromise.

5. Usage limits & quotas

Each plan includes a per-minute rate limit and a monthly quota, published in the console and the documentation. Once exceeded, the API responds with status 429 until the window or the monthly cycle resets. Profiting may reasonably adjust technical limits with prior notice.

6. Service level (SLA)

Profiting targets a monthly API availability of 99.5%, excluding scheduled maintenance (announced at least 24 hours in advance) and force majeure. The API is provided "as is"; the data depends on third-party market sources and may be delayed, incomplete or corrected. Custom plans may agree a specific SLA with remedies in writing.

7. Payments, renewal & cancellation

Subscriptions are billed in advance and renew monthly. The Customer may cancel at any time; access continues until the end of the paid period and no prorated refunds are issued unless required by law. Non-payment suspends API access. Free trials expire automatically unless converted into a subscription.

8. Ownership

The API data, brand and technology are owned by Profiting or its licensors. The Customer retains ownership of its products and the data it generates with them. The Customer may cite Profiting as the data source without implying endorsement beyond the contractual relationship.

9. Limitation of liability

To the maximum extent permitted by law, Profiting shall not be liable for lost profits, data loss or indirect damages arising from use of the API, including investment decisions based on the data. Profiting's total aggregate liability is limited to the amount paid by the Customer in the 12 months preceding the event giving rise to it.

10. Suspension & termination

Profiting may suspend or terminate access upon breach of these terms, fraudulent use or risk to the platform, with notice to the Customer. The Customer may terminate by cancelling its subscription. Sections 2, 8 and 9 survive termination.

11. Changes & contact

Profiting may update these terms by publishing the new version on this page and notifying material changes by email at least 15 days in advance. Continued use of the API after the effective date constitutes acceptance. Contact: no-reply@profiting.pro.
